Brantial Terms of Service

These Terms of Service (“Terms”) govern the use of the Brantial AI application (“Brantial”, “Service”), developed and operated by Webtures LTD. (“Webtures”, “we”). By using Brantial, you agree to these Terms.

1. Definitions

  • User: Any individual or entity using Brantial services.
  • Service: All AI-powered analysis, reporting, and content generation services provided through Brantial AI platform.
  • Customer Data: Prompts, content, account details, and payment information submitted by the User.
  • Outputs: Responses, reports, and analyses generated by Brantial through AI service providers.

2. Scope of Service

  • Brantial provides AI-powered SEO analysis, content suggestions, reporting, and other SaaS services.
  • The Service is provided “as-is”; Brantial does not guarantee that outputs will be error-free or always accurate.
  • Outputs are for informational and advisory purposes only and do not replace professional consulting.

3. Membership and Account Security

  • User must register with accurate and up-to-date information.
  • User is responsible for maintaining the security of account credentials.
  • User is liable for damages arising from unauthorized use of their account.

4. Subscription, Payment, and Cancellation

  • Services are subscription-based. Payments are processed via Stripe.
  • Subscriptions are valid for the selected term and automatically renew at the end of the period.
  • User may cancel before renewal. Paid fees are non-refundable unless legally required.
  • Brantial reserves the right to update pricing; changes take effect in the next renewal period.

5. Acceptable Use and Restrictions

  • Do not generate illegal, harmful, or infringing content.
  • Do not misuse the Service, including spam, attacks, or system overload.
  • Do not attempt reverse engineering or access to source code.
  • Do not resell, distribute, or sublicense the Service to third parties.

6. Third-Party Services

  • Brantial uses third-party providers such as AI service providers (OpenAI, Anthropic, Google AI, etc.), Google Analytics, Stripe, and Cloudflare.
  • These providers may process User data under their own privacy policies.
  • By using Brantial, User accepts these third-party integrations.

7. Data Ownership and Use

  • User retains ownership of prompts and content submitted to Brantial.
  • Brantial processes Customer Data solely to provide, improve, and comply with legal obligations.
  • Outputs may not be unique; Brantial does not guarantee uniqueness.
  • Brantial may use anonymized usage data (“telemetry”) without restriction to improve performance.

8. Intellectual Property Rights

  • The Brantial platform, software, infrastructure, design, and brand belong to Webtures LTD.
  • User may not reverse engineer, derive, or create derivative works of Brantial.
  • User may use Brantial outputs for commercial purposes but may not misrepresent them as official Brantial endorsement.

9. Disclaimer of Warranties and Liability

  • Brantial does not guarantee uninterrupted or error-free service.
  • AI outputs carry no guarantee of accuracy; User evaluates them at their own responsibility.
  • Brantial is not liable for direct or indirect damages, including loss of profit, data loss, or business interruption.

10. Term and Termination

  • User may close their account at any time.
  • Brantial may suspend or terminate accounts in case of Terms violations.
  • Upon termination, Customer Data will be deleted or anonymized in accordance with the Privacy Policy.

11. Privacy and Data Protection

  • Processing of User data is subject to the Brantial Privacy Policy.
  • The Privacy Policy is an integral part of these Terms.

12. Governing Law and Jurisdiction

  • These Terms are governed by the laws of England.
  • Courts of London shall have exclusive jurisdiction over disputes.

13. Changes

  • Brantial reserves the right to update these Terms.
  • Updates take effect upon publication on the website.
