These Terms of Service (“Terms”) are a legal agreement between you and WEBTURES LTD. (Company number 11948574), the operator of Brantial AI (“Brantial”, “we”, “us” or “our”). They govern your access to and use of Brantial’s website, application, APIs, reports, integrations, and related services (together, the “Service”).
By creating an account, purchasing a subscription, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who These Terms Apply To
You must have the legal capacity to enter into a binding contract. If you use the Service for a company or another organization, you confirm that you have authority to accept these Terms on its behalf; in that case, “you” and “Customer” refer to that organization.
If a separate order form, enterprise agreement, data processing agreement, or written addendum signed by both parties conflicts with these Terms, the signed document controls to the extent of that conflict.
The Service is designed principally for business and professional use. Nothing in these Terms limits mandatory rights that cannot lawfully be excluded, including applicable consumer rights.
2. Definitions
- Customer Data: data, prompts, content, files, account information, integration data, and other material submitted to or made available through the Service by or for Customer.
- Documentation: user-facing instructions, technical information, and usage guidance Brantial makes available for the Service.
- Output: a response, score, report, recommendation, analysis, or other material generated through the Service.
- Subscription Term: the period for which Customer has purchased access to a paid plan.
- User: an individual authorized by Customer to access the Service.
3. The Service
Brantial provides AI visibility measurement, GEO and AEO analysis, reporting, content and workflow assistance, and related software features. The features, usage allowances, and support included in a subscription are those shown in the applicable plan or order at the time of purchase.
We may improve, modify, or replace features as the Service evolves. We will not knowingly make a material change solely to avoid an existing contractual obligation. Features identified as beta, preview, experimental, or free may be changed or withdrawn at any time and may be subject to additional limitations.
The Service does not replace legal, financial, compliance, medical, or other regulated professional advice.
4. Accounts and Customer Responsibilities
You must:
- provide accurate account and billing information and keep it current;
- protect credentials, API keys, and connected accounts from unauthorized use;
- give Users only the permissions they need and promptly remove access that is no longer authorized;
- remain responsible for activity under your account, except to the extent caused by Brantial’s breach of its obligations;
- notify us promptly at hello@brantial.ai if you suspect unauthorized access or a security incident; and
- use the Service and Outputs in accordance with applicable law, these Terms, and the Documentation.
You are responsible for determining whether the Service and any Output are suitable for your intended use.
5. Subscriptions, Fees, and Cancellation
- Paid plans are billed in advance for the billing period shown at checkout or in the applicable order.
- Payments are processed by Stripe or another payment provider identified at checkout. You authorize the provider to charge the applicable fees, taxes, and any agreed recurring amounts.
- Unless the order states otherwise, a paid subscription renews automatically for the same billing period until cancelled.
- You may cancel renewal through the available account controls or by contacting us before the renewal date. Cancellation stops future renewal and normally takes effect at the end of the current paid term.
- Fees already paid are non-refundable except where required by law or expressly stated in an applicable order or refund policy.
- We may change plan pricing for a future renewal. We will provide reasonable advance notice of a price change that affects an existing paid subscription.
- If an undisputed payment is overdue, we may limit or suspend paid features after giving notice and a reasonable opportunity to resolve the issue where practicable.
Taxes are your responsibility except for taxes imposed on Brantial’s net income. If we are legally required to collect a tax, it may be added to the amount charged.
6. Acceptable Use
You must not, and must not help another person to:
- use the Service for unlawful, fraudulent, deceptive, harmful, or rights-infringing activity;
- submit material that you do not have the right or lawful basis to use;
- use the Service to generate or distribute malware, spam, harassment, or content that facilitates unlawful harm;
- probe, scan, disrupt, overload, or bypass the security or access controls of the Service;
- access another customer’s account or data without authorization;
- reverse engineer, decompile, or attempt to discover non-public source code except to the limited extent such restriction is prohibited by law;
- scrape or access the Service through automated means except through an authorized API or as expressly permitted in writing;
- resell, sublicense, or provide the Service as a standalone product to a third party unless your plan or written agreement permits it;
- remove proprietary notices or misrepresent an Output as an official endorsement by Brantial; or
- use the Service or Outputs to develop or train a competing model or service where prohibited by your plan or a written agreement.
We may investigate suspected misuse and cooperate with lawful requests from competent authorities.
7. Customer Data and Permissions
As between Customer and Brantial, Customer retains its rights in Customer Data. Customer grants Brantial a limited, non-exclusive right to host, copy, transmit, process, and display Customer Data only as reasonably necessary to provide, secure, support, and improve the Service, comply with law, and enforce these Terms.
Customer confirms that it has all rights, permissions, notices, and lawful bases needed for Brantial and its providers to process Customer Data as described in these Terms and the Privacy Policy. Customer is responsible for instructions it gives through connected services and for the legality, accuracy, and quality of Customer Data.
We may create aggregated or de-identified data that does not reasonably identify Customer, a User, or another individual. We may use that data to operate, analyze, secure, and improve the Service, provided we do not attempt to re-identify it.
8. AI-Generated Outputs
Outputs are generated using automated systems and may contain errors, omissions, outdated information, or material similar to outputs provided to other users. Brantial does not guarantee that an Output is unique, complete, accurate, or suitable for a particular purpose.
You must review Outputs before publishing, implementing, or relying on them and must carry out any human, factual, legal, brand, and compliance review appropriate to your use. You remain responsible for decisions and actions taken based on an Output.
Subject to applicable law, third-party rights, and these Terms, Brantial does not claim ownership of your Output. Because AI-generated material may not qualify for intellectual-property protection in every jurisdiction, no representation is made that exclusive rights will arise in an Output.
9. Third-Party Services and Integrations
The Service may interoperate with providers such as AI model services, Google products, Stripe, Cloudflare, analytics services, and other platforms you choose to connect. A third-party service is governed by its own terms and privacy notice, and Brantial is not responsible for that service’s independent acts, availability, or changes.
You authorize Brantial to exchange the data necessary to perform the integration you enable. You may need to maintain a valid third-party account and permissions. Removing access or a provider changing its API may limit or stop the related Brantial feature.

10. Confidentiality
Each party may receive non-public information that is identified as confidential or that a reasonable person would understand to be confidential (“Confidential Information”). The receiving party will use reasonable care to protect it and will use it only to perform or receive the Service and exercise rights under the agreement.
Confidential Information does not include information that the receiving party can show was lawfully known without restriction, becomes public without breach, is received lawfully from another source without confidentiality duty, or is independently developed without use of the disclosing party’s Confidential Information.
A party may disclose Confidential Information where lawfully required, but where permitted it will give reasonable notice and disclose only what is required. These duties continue after termination for as long as the information remains confidential.
11. Intellectual Property and Feedback
Brantial and its licensors retain all rights in the Service, software, models and orchestration, interfaces, Documentation, designs, trademarks, and other technology, excluding Customer Data and any rights in Outputs granted under Section 8. No right is granted except the limited right to use the Service under these Terms.
If you provide feedback or suggestions, you grant Brantial a worldwide, perpetual, irrevocable, royalty-free right to use them without restriction or obligation, provided we do not publicly identify you as the source without permission.
12. Service Changes, Suspension, and Termination
You may stop using the Service or close your account at any time, subject to the subscription terms in Section 5.
We may suspend or restrict access when reasonably necessary to address a security risk, unlawful use, a material breach, overdue undisputed payment, harm to the Service or others, or a binding legal requirement. Where practicable, we will provide notice and an opportunity to remedy the issue. We may terminate access for a material breach that is not remedied within a reasonable period, or immediately where the breach cannot be remedied or continued access creates serious risk.
On termination, your right to use the Service ends. Treatment of Customer Data follows the Privacy Policy and any applicable written agreement. Sections that by their nature should continue—including payment obligations, confidentiality, intellectual property, disclaimers, liability, and general legal terms—survive termination.
13. Warranties and Liability
We will provide the Service with reasonable care and skill. Except for this express commitment and any warranty that cannot lawfully be excluded, the Service and Outputs are provided “as is” and “as available”. We do not warrant uninterrupted operation, a particular ranking or commercial result, or that every error or vulnerability will be identified or corrected.
To the maximum extent permitted by law, Brantial is not liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or for loss of profit, revenue, goodwill, anticipated savings, or business opportunity arising from use of the Service. Brantial is not responsible for loss caused by Customer Data, Customer instructions, unauthorized account use not caused by Brantial, or a third-party service outside Brantial’s reasonable control.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Any mandatory rights and remedies available under applicable law remain unaffected.
14. Privacy and Data Protection
Our Privacy Policy explains how we process personal data when acting as controller. Where Brantial processes personal data on behalf of a business customer, the parties will comply with applicable data-protection law and any data-processing terms that apply to the subscription.
You must not use the Service to process sensitive or regulated data in a way that requires safeguards Brantial has not expressly agreed to provide.
15. General Legal Terms
- Notices: Legal notices to Brantial must be sent to hello@brantial.ai and may also be posted to our registered office. We may send notices to the account email or display them in the Service.
- Force majeure: Neither party is responsible for delay or failure caused by events beyond its reasonable control, provided it takes reasonable steps to reduce the impact.
- Assignment: Neither party may assign the agreement without the other’s consent, not to be unreasonably withheld, except in connection with a merger, reorganization, financing, or sale of substantially all relevant assets, provided the successor assumes the obligations.
- No waiver: A failure or delay in enforcing a right is not a waiver of that right.
- Severability: If a provision is unenforceable, it will be adjusted only as much as necessary, and the remaining provisions continue in effect.
- No partnership: These Terms do not create a partnership, joint venture, employment, fiduciary, or agency relationship.
- Entire agreement: These Terms and any documents expressly incorporated into them form the entire agreement about the Service and replace prior discussions on the same subject.
16. Governing Law, Disputes, and Changes
These Terms and any non-contractual dispute arising from them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except where mandatory law gives you the right to bring a claim elsewhere.
Before starting formal proceedings, each party should make a good-faith attempt to resolve the dispute by written notice describing the issue and requested outcome.
We may update these Terms to reflect changes in the Service, law, security, or business practices. The updated version will show a new effective date. If a change materially affects an existing paid subscription, we will provide reasonable notice where required. Continued use after the effective date constitutes acceptance, except where applicable law requires another form of consent.
